“Fuhrer’s Law”

Today Naomi Wolf posted an important blog reporting on an interview with Michael Ratner, a well-known US constitutional scholar, at the Center for Constitutional Rights and Columbia Law School. Wolf interviewed Ratner, seeking his opinion on the significance of the John Yoo memos released by the Obama Administration. He replied, in part:

”What they mean is that your book looks moderate in respect to those issues now. This — what is in the memos — is law by fiat.

”I call it “Fuhrer’s law.” What those memos lay out means the end of the system of checks and balances in this country. It means the end of the system in which the courts, legislature and executive each had a function and they could check each other.”

This one is worth a read, and when you’re finished, you’ll realize what a narrow escape we all had, and how much there is still to do to clean up the mess left by the Bush Administration.
